The Delhi High Court today has granted time to the National Anti-Doping Agency (NADA) to file reply to a plea filed by Athlete Abhijeet Gurav challenging his suspension from participating in any power-lifting competition in the world, after the agency charged him for violation of its rules.
A divisional bench comprising Chief Justice D.N. Patel and Justice Prateek Jalan while hearing the petition through video conferencing allowed the time sought by the counsel appearing for the NADA for filing a reply in this matter.
A plea has been filed by Abhijeet Gurav through his advocate Mr. Debesh Panda challenging his suspension from powerlifting in any championship around the world by NADA.
Ms. Manpreet Kaur Bhasin, Counsel appearing for the respondents submitted that steroids have been found in his urine test and accordingly the action has been taken under the National Anti-Doping Rule, 2015. Ms. Manpreet further added that Abhijeet has yet not exhausted his remedies provided under the said rules and has approached directly to the High Court.
Whereas, Mr. Debesh contended by stating that Article 7.3 (f) of the National Anti-Doping Rule, 2015 is against the Article 14, 19(1) (g) and 21 of the Constitution of India and World Anti-Doping Code, 2015.
Mr. Debesh further added that Abhijeet’s suspension is arbitrary, illegal and violates the Rights provided under 14, 19(1) (g) and 21 of the Constitution of India.
However, Ms. Manpreet has sought time for filing a reply in the matter and the court has listed the matter for 13th August 2020.
