Rajasthan Assembly speaker CP Joshi, filed petition in the Supreme Court today (July 22) against the Rajasthan High Court order restraining him from taking action against 19 dissident MLAs, headed by ex Deputy Chief Minister Sachin Pilot.
The Rajasthan High Court had held three days of hearing and has reserved its verdict, to be given on Friday. The Speaker, through his lawyer in the high court, had, however, expressed his “reluctance” to wait that long. When the court ordered the Speaker cannot take action against the dissidents till Friday, the speaker decided to go to the top court.
The Special Leave Petition has been filed by Rajasthan Legislative Assembly Speaker through AOR Sunil Fernandes challenging the Order of Rajasthan High Court stating that State High Court order to him to defer the Tenth Schedule (anti-defection) proceedings till July 24, is a “direct intrusion” by the judiciary into his exclusive domain.
Senior Advocate Kapil Sibal mentions the matter before the bench of the Chief Justice SA Bobde today, to urgently hear the matter. “we need to mention it urgently, there needs to be a mechanism,” he said.
CJI refused to hear the matter and said approach the registry first, registry will list it.
Senior Advocate Kapil Sibal said, this is travesty of justice. There needs to be urgent hearing. The disqualification proceedings is stayed till July 24.
